Mandatory Agency Disclosure

Seller Agents, Buyer Agents and Facilitators

 

The Commonwealth of Massachusetts requires all real estate agents to have a brief discussion about "agency" with consumers.  This conversation is to take place "at the first personal meeting to discuss a specific property".  The Commonwealth then requires that you, the consumer, understand and sign the Mandatory Agency Disclosure form.  Before personally providing you with this document we prefer to inform customers of this requirement as well as explain its purpose.

Agency is the relationship that is established between agents and sellers and agents and buyers.  In the Commonwealth, (on the selling side), agents work for the seller when they have a contract to sell their home and, (on the buying side), agents work as facilitators unless they are hired by the buyer to work on their behalf.  This is important to understand because many times buyers and sellers think an agent is automatically working on their behalf and automatically looking out for their best interest. This is not the case. Agents can only work with and for sellers and with and for buyers after a contract has been signed by the parties.
